Beta Program Agreement

Last updated: 19 October 2026.

These Beta Terms apply to anyone Toronado Entertainment, LLC, doing business as Aclamos (“Aclamos”) admits to its private beta of the Aclamos awards platform and the Ballotis voting platform. They supplement but do not replace our Terms of Service, Privacy Policy, and DPA.

1. Beta access & fees

In these Beta Terms, a “Program” means one awards season, election, ballot, or event you run on the Service — from the day it opens to entrants or voters until the day its results are final.

If admitted, you receive access to features that may otherwise be paid, free of charge for the duration of the beta.

At least 90 days' notice before the beta ends. Aclamos may end the beta, or end your participation in it for any reason other than those listed in section 8, only by giving you at least 90 days' written notice. Notice is given by email to the owner and admin email addresses on your organization's account. The notice will state the date the beta, or your participation, ends (the “End Date”), and the End Date will be at least 90 days after the day we send the email. Keeping those email addresses current is your responsibility; notice sent to them counts as given.

Programs underway are protected. If a Program of yours opens on or before the End Date, your access to the Service for that Program continues free of charge, on these terms, until the Program closes, even if the End Date passes first. We will not move you onto a paid plan, reduce the features your Program depends on, or withdraw your access in the middle of a Program.

After the beta ends, paid plans apply to Programs you start thereafter, unless we agree otherwise in writing.

2. Service is “as-is”

Beta features are pre-release, may contain bugs, may change or be removed without notice, and are not warranted to meet your requirements. Aclamos provides the beta features “as-is” and disclaims all warranties, express or implied, to the maximum extent permitted by law. Production use is at your own risk.

The beta is meant for real Programs — that is the point of it, and section 1 protects the ones you have on the calendar. But if your Program carries legal or regulatory weight beyond your own rules (a statutory board election, for example, or a vote whose outcome must satisfy a regulator), tell us before it opens so we can agree in writing what we will support and what we will not.

3. Feedback license

Any feedback, bug reports, suggestions, or feature requests you provide are non-confidential. You grant Aclamos a perpetual, irrevocable, royalty-free, worldwide license to use, modify, and incorporate that feedback into our products without obligation to you. You retain all rights in your own data and content.

4. Confidentiality of unreleased features

You agree not to publicly disclose unreleased features, performance metrics, or issues you encounter in the beta until Aclamos has announced them — except that you may discuss them with employees and contractors who need to know and are bound by similar confidentiality. Negative or critical commentary about features that have been publicly announced is always permitted.

5. Logo & case-study use

If we want to publish your logo or a case study about your use, we will ask first. We will not publish anything without your explicit written approval — a reply to our email saying yes is enough; it does not need to be a formal document.

6. Data protection

The DPA applies during the beta. We do not train AI models on your data. Sub-processor list at /subprocessors.

7. Liability cap

For Customers in the beta program, Aclamos's aggregate liability under these Terms is capped at USD 100, except for claims that cannot be capped under applicable law (e.g. gross negligence, willful misconduct, IP infringement indemnity).

8. Term & termination

The beta runs from when we admit you until the End Date, or until your participation is terminated under this section.

You may terminate whenever you like, including in the middle of a Program, by telling us in writing. Aclamos may end your participation for convenience only on the 90 days' notice in section 1, and subject to the Program protection there. Aclamos may terminate your participation on 7 days' written notice for material breach of these Beta Terms, the Terms of Service or the Acceptable Use Policy, or sooner where the law or a platform we depend on requires us to stop. The 90-day notice and the Program protection do not apply in those cases.

Sections 3, 6, and 7 survive termination.

9. Governing law

The laws of the State of Florida (USA) govern, without regard to conflict-of-laws principles. The exclusive venue for any dispute is the state and federal courts located in Lake County, Florida — except that EU/UK consumers retain the right to bring claims in the courts of their place of residence where local law so provides.

10. Acceptance
